When properly applied, (dba) Ames Research Laboratories, Inc. (“we” or “us”) warrants that Product was free from manufacturing defects at the time of manufacture. THIS LIMITED WARRANTY EXCLUDES ALL OTHER EXPRESS OR IMPLIED WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE. This warranty does not apply to any water containment system including, without limitation, cisterns, pools, fountains, water features, holding tanks and ponds.

This warranty shall not apply if the Product is not applied in accordance with all labels and directions on properly prepared and approved surfaces; when the Product fails due to improper product application, insufficient coating thickness, or improper surface preparation; cracked structural surfaces; reoccurring efflorescence; or any conditions not reasonably foreseen by us.

Package labeling, application guides, internet demonstrations, other internet information, and specifications are all as complete as possible, but cannot encompass all conditions, applications and/or surfaces so therefore are considered suggestions only. It is the responsibility of the purchaser to follow the most current packaging, websites and literature instructions published at the time of application and failure to follow such instructions shall void this limited warranty. Application information is subject to periodic revision and actual site conditions may affect performance. The user is further responsible for complying with local construction regulations and codes.

All customers are advised to conduct their own test in actual use conditions before using the product. Purchase of the product acknowledges acceptance of these terms.

Products for Waterproofing: Waterproofing projects can frequently involve a combination of products and systems working together to provide the intended waterproofing.

Substrate Limitations: No warranty is given for application of any of our products when applied over dirty, wet, contaminated, or deteriorated substrates that are not first cleaned or rehabilitated to a useable condition. It is the user’s responsibility to identify and resolve any substandard substrate conditions.

Adhesion Exclusions: Sale of materials to user does not imply acceptance by us or buyers intended use or substrate. It is the responsibility of the user to apply test patches of the product at recommended rates and conduct any testing to confirm adhesion to their substrate.

Frozen Product Exclusions: Products may freeze during storage or application in freezing temperatures. Freezing product is not covered under product defect warranty.

Use of Product in Conjunction with the Products of Others: Some products by others that may be used in conjunction with our products include - but may not be limited to - foundation drainage systems, protection board, plumbing connections, backfill materials, roof ballast, cleaning chemicals, etc. No warranty is expressed nor implied on failures of product to perform due to differing systems or materials being installed incorrectly or without regard to compatibility with our products
